Amendment was proposed by the 8th Congress on December 9, 1803 altering the procedure of the Electoral College to avoid a recurrence of the tie between Jefferson and Burr in the 1800 election by forcing discrete votes for president and vice-president; the proposal was ratified as Amendment XII on June 15, 1804. No copy is known extant; Swem reported the title above from the House journal; the House of Delegates considered the amendment after ordering the public printer, Meriwether Jones, on December 20, 1803. to print 250 copies for use during their deliberations; the Assembly approved the amendment by a resolution of the whole house on December 28th.
